These Terms of Sale govern the sale of subscriptions to the Whispever service offered by Whispever, sole proprietor.

Any order for a Whispever subscription implies unconditional acceptance of these Terms of Sale as well as the Terms of Use.

Note: Other plans may be offered in the future (Lifetime plan, enterprise plans, etc.)
Prices are shown in euros, all taxes included (TTC). As a sole proprietor, we are not subject to VAT.
Whispever reserves the right to modify its prices at any time. However, the applicable prices are those in effect at the time of order.

In accordance with Article L.213-1 of the French Consumer Code, we keep a copy of contracts concluded electronically for a period of 10 years.
We accept the following payment methods via our secure payment provider Stripe:
Payments are fully secured via Stripe, a certified PCI-DSS Level 1 provider (the highest security standard for online payments).
Whispever does not store and never has access to your complete banking information (card number, CVV, etc.). All payment information is directly processed and secured by Stripe.

The price is payable in full on the date of order. The subscription is only activated after payment is received.
In case of payment default or rejected charge for renewal:
Your subscription is managed via Stripe. You will receive:
In case of payment issues, Stripe will automatically retry the charge according to their retry policy (generally 3 to 4 attempts over several days).
The annual subscription is taken out for a period of 12 months from the subscription date.
Unless you cancel, the subscription is automatically renewed for a new 12-month period at the current rate.

In accordance with Article L.221-18 of the French Consumer Code, you have 14 days to exercise your right of withdrawal without having to justify reasons or pay penalties.

You can view your complete payment history and download your invoices at any time from your Whispever user interface.

Failing an amicable resolution, French courts will have sole jurisdiction, in accordance with French law.
Whispever cannot be held responsible for non-performance of its obligations in case of force majeure, including:

If one or more provisions of these Terms of Sale are held to be invalid or declared as such, the other provisions retain their full force and effect.

These Terms of Sale, together with the Terms of Use and Privacy Policy, constitute the entire agreement between you and Whispever regarding the use of the service.
